Welcome to Studio Kritique. These Terms of Service (“Terms”) govern your access to and use of www.studiokritique.com and any related services, consultations, orders, products, fittings, alterations, communications, and purchases provided by Studio Kritique Private Limited (“Studio Kritique”, “we”, “our”, or “us”).

By accessing our Website, submitting an enquiry, booking a consultation, placing an order, making a payment, approving a design, attending a fitting, or purchasing any product or service from us, you agree to be bound by these Terms.

Please read these Terms carefully before placing an order.


1. General Information

1.1 Studio Kritique is a fashion design and bespoke tailoring studio based in India.

1.2 All design, tailoring, customisation, handwork, quality control, and production activities are carried out in India, unless expressly stated otherwise in writing.

1.3 We may accept orders from customers in India and from international customers, subject to serviceability, shipping availability, payment acceptance, customs requirements, and our written order confirmation.

1.4 Studio Kritique operates primarily on a bespoke, made-to-measure, made-to-order, and customised production model. This means that garments are not mass-produced ready-to-wear products. They are designed, customised, altered, or produced after an order, consultation, measurement, design approval, or payment has been completed.

1.5 All garments involve a degree of handwork, tailoring, fitting, fabric handling, finishing, and individual interpretation. Small variations in colour, texture, embroidery, print placement, drape, hand finish, fabric fall, measurements, or detailing may occur and are part of the nature of bespoke and handcrafted garments.

1.6 These Terms apply together with our Privacy Policy, Shipping Policy, Cancellation, Return & Refund Policy, and any order-specific quotation, invoice, written confirmation, design approval, or communication issued by Studio Kritique.


2. Nature of Our Products and Services

2.1 Studio Kritique provides bespoke, made-to-measure, made-to-order, customised, and limited-production fashion services. These may include, but are not limited to:

  • bespoke dresses;
  • occasion wear;
  • bridal and wedding-related garments;
  • bridesmaid and cocktail dresses;
  • Indian fusion wear;
  • co-ord sets;
  • vacation wear;
  • tailored formal or workwear;
  • alterations, fittings, styling inputs, and garment customisation.

2.2 Unless expressly stated otherwise, our garments are produced or customised specifically for the customer after an order is placed. Therefore, they cannot be treated in the same way as standard ready-to-wear retail products.

2.3 Product images, campaign images, lookbook images, website photos, social media posts, sketches, fabric references, and sample garments are intended to communicate the overall design direction. The final garment may vary depending on fabric availability, body measurements, fitting requirements, handwork, styling choices, and approved customisations.


3. Domestic and International Orders

3.1 Studio Kritique may accept orders from customers located in India and from customers located outside India.

3.2 Acceptance of an international order is subject to Studio Kritique’s written confirmation, payment acceptance, shipping feasibility, courier serviceability, customs rules, and any applicable legal or logistical restrictions.

3.3 Studio Kritique reserves the right to refuse, cancel, or decline any domestic or international order where we are unable to service the location, process the payment, verify the order, arrange delivery, comply with applicable requirements, or complete the order within a reasonable or agreed timeframe.

3.4 International customers are responsible for providing accurate shipping details, recipient information, customs documentation information where required, and any other information needed to process delivery.

3.5 For international orders, the customer is responsible for all customs duties, import taxes, local taxes, clearance charges, brokerage fees, storage charges, re-delivery charges, and any other destination-country charges, unless expressly stated otherwise in writing.

3.6 Studio Kritique is not responsible for delays caused by customs clearance, import restrictions, courier handling, government checks, incomplete customer information, non-payment of duties, or local delivery issues in the destination country.

3.7 If an international shipment is refused, abandoned, returned, delayed, held, destroyed, or charged additional fees due to customs, incorrect address, non-payment of duties, import restrictions, or customer unavailability, the customer may be responsible for all resulting costs.


4. Enquiries, Consultations and Order Process

4.1 Submitting an enquiry through the Website, WhatsApp, email, Instagram, phone, or any other communication channel does not create a binding order.

4.2 A binding order is created only when Studio Kritique confirms the order in writing and receives the required payment, advance payment, deposit, or full payment, as applicable.

4.3 The typical bespoke order process may include:

  • customer enquiry;
  • consultation or design discussion;
  • quotation or price estimate;
  • customer approval;
  • payment, advance payment, or deposit;
  • measurement collection;
  • fabric, design, colour, silhouette, embroidery, or styling confirmation;
  • pattern making, cutting, tailoring, embroidery, production, or sourcing;
  • one or more fittings, where applicable;
  • final approval;
  • balance payment;
  • delivery, collection, or dispatch.

4.4 Depending on the product or service, Studio Kritique may modify this process. Certain products may not require all stages.

4.5 Any design, fitting, fabric, styling, price, or timeline discussed verbally is not binding unless confirmed by Studio Kritique in writing.


5. Customer Responsibilities

5.1 The customer is responsible for providing accurate, complete, and timely information required for the order, including but not limited to:

  • name, contact details, delivery address, and billing details;
  • body measurements;
  • event date, if any;
  • preferred fit, silhouette, length, colour, fabric, and design details;
  • size changes, pregnancy, weight changes, medical constraints, or other relevant body-related information;
  • special requirements, deadlines, or sensitivities;
  • customs or recipient information for international orders, where applicable.

5.2 If the customer provides incorrect measurements, incomplete information, delayed approvals, wrong contact details, an incomplete address, or fails to attend scheduled fittings, Studio Kritique will not be responsible for resulting delays, fit issues, additional costs, failed delivery, customs problems, or inability to complete the order within the estimated timeline.

5.3 For fittings, the customer should wear or bring the intended undergarments, shapewear, footwear, accessories, or other items that may affect the final fit and length of the garment.

5.4 Any change in body measurements, posture, weight, pregnancy, footwear, undergarments, or styling after measurements or fittings may affect the final fit. Additional alterations caused by such changes may be chargeable.

5.5 The customer must review all design details, fabrics, colours, measurements, sketches, references, or written confirmations carefully before approving them. Once approved, changes may not be possible or may involve additional charges.

5.6 For remote or international orders, the customer is responsible for ensuring that measurements are taken accurately according to Studio Kritique’s guidance. Where measurements are provided remotely by the customer, Studio Kritique is not responsible for fit issues caused by inaccurate, incomplete, or incorrectly taken measurements.


6. Design Approval and Changes

6.1 Once a customer approves a design, quotation, fabric, colour, measurement, embroidery, silhouette, or other order detail, Studio Kritique may begin sourcing, cutting, tailoring, embroidery, or production.

6.2 Any requested changes after approval are subject to feasibility, fabric availability, production stage, artisan availability, and Studio Kritique’s discretion.

6.3 Studio Kritique may charge additional fees for any post-approval change, including but not limited to changes in:

  • design;
  • fabric;
  • length;
  • fit;
  • silhouette;
  • colour;
  • embroidery;
  • embellishment;
  • lining;
  • sleeve style;
  • neckline;
  • delivery timeline;
  • additional fittings;
  • international shipping method or destination.

6.4 Studio Kritique is not obligated to accept late-stage changes once production, embroidery, cutting, finishing, or final fitting has started.


7. Fabric, Colour and Handmade Variations

7.1 Studio Kritique works with fabrics, trims, embroidery, embellishments, prints, dyes, hand-finishing, and artisanal techniques. Natural and handmade variations may occur.

7.2 Minor variations in colour, texture, weave, print placement, embroidery placement, embellishment density, drape, hand finish, or fabric fall shall not be considered defects.

7.3 Colours shown on the Website, social media, digital screens, campaign images, or photographs may vary due to lighting, screen settings, camera settings, editing, dye lots, and fabric availability.

7.4 Where fabrics, trims, embellishments, or materials become unavailable, Studio Kritique may suggest suitable alternatives. The order will proceed only after customer approval where the change is material.

7.5 The customer acknowledges that handmade and bespoke garments cannot be identical to campaign images, reference images, sketches, sample garments, or previous pieces.


8. Pricing, Taxes and Payment

8.1 Prices are communicated through the Website, quotation, invoice, checkout page, or written confirmation, as applicable.

8.2 Prices may vary depending on design complexity, fabric, embroidery, embellishment, lining, tailoring effort, number of fittings, urgency, customisation level, shipping destination, and other order-specific requirements.

8.3 Unless otherwise stated, prices are shown in Indian Rupees or in another displayed currency and include or exclude taxes as indicated at checkout, on the invoice, or in the written quotation.

8.4 For orders delivered within India, applicable Indian taxes may be included or charged as required by law.

8.5 For international orders, prices shown or paid to Studio Kritique do not include customs duties, import taxes, local destination-country taxes, brokerage fees, or other charges imposed by the destination country, unless expressly stated otherwise in writing.

8.6 Studio Kritique may require full payment, advance payment, deposit, or milestone-based payment depending on the order.

8.7 Production will begin only after the required payment has been received.

8.8 Final delivery, dispatch, or collection may be withheld until all outstanding amounts have been paid in full.

8.9 Payment methods accepted by Studio Kritique may include [insert payment methods, e.g. credit card, debit card, UPI, net banking, bank transfer, payment gateway, international card payment, or other approved methods].

8.10 Any payment gateway charges, bank charges, failed payment charges, currency conversion charges, foreign transaction charges, or transaction fees may be borne by the customer, unless otherwise required by applicable law.


9. Deposits and Advance Payments

9.1 For bespoke, made-to-measure, made-to-order, customised, bridal, occasion, or special production orders, Studio Kritique may require a non-refundable deposit or advance payment.

9.2 The deposit or advance payment secures design time, consultation time, production capacity, fabric sourcing, material procurement, artisan allocation, pattern work, tailoring work, embroidery planning, and other order-specific preparation.

9.3 Once Studio Kritique has started work, sourced materials, blocked production capacity, begun design development, pattern making, cutting, embroidery, tailoring, or any related production activity, the deposit or advance payment may not be refundable.

9.4 Any refund, credit, or adjustment will be assessed based on the order stage, work already performed, materials sourced, non-recoverable costs, payment processing costs, shipping status, and applicable law.


10. Cancellation Policy

10.1 Because our products are bespoke, made-to-order, made-to-measure, customised, or produced specifically for the customer, cancellation rights are limited.

10.2 A customer may request cancellation within 24 hours of placing the order, provided that Studio Kritique has not already started sourcing, cutting, production, embroidery, customisation, or other order-specific work.

10.3 After 24 hours, cancellation requests may be declined or may be subject to deductions for work already performed, materials sourced, production capacity blocked, design time spent, payment gateway charges, administrative costs, and other non-recoverable expenses.

10.4 Once production, cutting, embroidery, tailoring, alteration, sourcing, or customisation has started, the order may not be cancellable.

10.5 For bridal, occasion, urgent, heavily customised, embroidered, altered, or special-order garments, cancellations may not be accepted after order confirmation.

10.6 Studio Kritique may cancel an order if:

  • required materials are unavailable;
  • payment is not received;
  • customer information is incomplete or inaccurate;
  • the customer fails to provide measurements or approvals;
  • the customer does not attend required fittings;
  • the destination is not serviceable;
  • the shipment cannot be processed;
  • customs or import restrictions prevent fulfilment;
  • the order is outside our service scope;
  • we are unable to fulfil the order due to circumstances beyond our reasonable control.

10.7 If Studio Kritique cancels an order due to our inability to fulfil it, we may offer a refund, credit note, replacement option, alternative fabric, revised timeline, or another suitable resolution, subject to applicable law and the order status.


11. Returns, Exchanges and Refunds

11.1 Bespoke, made-to-measure, made-to-order, customised, altered, embroidered, personalised, client-approved, or specially produced garments are not eligible for return, exchange, or refund merely because of:

  • change of mind;
  • subjective dissatisfaction;
  • event cancellation;
  • personal preference;
  • change in styling preference;
  • body measurement changes;
  • weight changes;
  • delayed customer approvals;
  • incorrect measurements provided by the customer;
  • incorrect address or contact details;
  • minor handmade variations;
  • minor colour, texture, print, embroidery, or fabric variations;
  • customer failure to attend fittings;
  • customer failure to follow care instructions;
  • customs duties, import taxes, or destination-country charges;
  • delivery delays caused by customs, courier services, or customer-side issues.

11.2 Refunds are not offered for bespoke or custom-made items except where required by applicable law or where Studio Kritique confirms that the product has a material defect, fulfilment error, or substantial deviation from the confirmed order that cannot reasonably be corrected.

11.3 If the customer receives a defective, damaged, incorrect, or materially different product, the customer must notify Studio Kritique in writing within 3 days of receipt or collection.

11.4 The customer must provide the order number, clear photographs, description of the issue, and any supporting information requested by Studio Kritique.

11.5 Products returned without prior written approval from Studio Kritique may not be accepted.

11.6 To be eligible for review, the product must be unused, unworn except for trial purposes, unwashed, unaltered, undamaged, and returned with original packaging, tags, labels, and any accessories, where applicable.

11.7 Studio Kritique reserves the right to inspect the product before deciding whether the issue qualifies as a defect, alteration request, repair, replacement, credit, refund, or non-eligible claim.

11.8 Where a defect or fulfilment error is confirmed, Studio Kritique may, at its discretion and subject to applicable law, offer repair, alteration, replacement, store credit, partial refund, or refund.

11.9 Shipping charges, return shipping charges, customs duties, import taxes, payment gateway charges, express delivery charges, and other service charges may be non-refundable unless otherwise required by applicable law or unless the return is caused by a confirmed error by Studio Kritique.

11.10 This section does not exclude any mandatory consumer rights available under applicable law.


12. Alterations and Fit Adjustments

12.1 Bespoke garments may require fittings and minor adjustments as part of the tailoring process.

12.2 Studio Kritique will make reasonable efforts to achieve the agreed fit and design direction based on the measurements, fittings, approvals, and information provided by the customer.

12.3 Fit is partly subjective and depends on body shape, posture, fabric, garment structure, styling preference, undergarments, footwear, and movement.

12.4 Minor fit adjustments identified during scheduled fittings may be included where expressly agreed by Studio Kritique.

12.5 Additional alterations may be chargeable where they are caused by:

  • customer measurement errors;
  • customer body changes;
  • late design changes;
  • change of footwear or undergarments;
  • missed fittings;
  • delayed feedback;
  • customer preference changes;
  • third-party alterations;
  • improper use, washing, storage, or handling.

12.6 For remote or international customers, alterations may be limited by distance, shipping costs, customs procedures, and the practical ability to conduct fittings.

12.7 If a customer requests alteration support after international delivery, the customer may be responsible for shipping costs, customs costs, duties, taxes, and any local charges associated with sending the garment back to Studio Kritique or receiving it again.

12.8 Once a garment has been collected, delivered, worn, washed, altered by a third party, damaged, or used for an event, Studio Kritique may refuse further alteration, return, exchange, or refund requests.


13. Shipping and Delivery

13.1 Production and delivery timelines vary depending on design complexity, fabric availability, embroidery, number of fittings, customer approvals, payment completion, order volume, artisan availability, courier service, customs processing, and destination.

13.2 Any timeline provided by Studio Kritique is an estimate unless expressly confirmed in writing as a guaranteed delivery date.

13.3 Studio Kritique is not responsible for delays caused by:

  • delayed payment;
  • delayed customer approvals;
  • incorrect or incomplete measurements;
  • missed fittings;
  • incorrect delivery address;
  • unreachable phone number;
  • courier delays;
  • weather conditions;
  • strikes;
  • customs clearance;
  • customs inspections;
  • import restrictions;
  • local delivery issues;
  • force majeure events;
  • fabric or material supply delays;
  • circumstances beyond our reasonable control.

13.4 The customer must ensure that the delivery address and contact number are complete and accurate.

13.5 If delivery fails due to customer unavailability, incorrect address, incomplete address, unreachable phone number, refusal to accept delivery, non-payment of customs duties, or failure to complete customs requirements, additional shipping, return, storage, or re-delivery charges may apply.

13.6 Risk of loss or damage may pass to the customer once the order is handed over to the courier, delivery partner, or customer, subject to applicable law.

13.7 For urgent orders or express delivery, additional charges may apply and acceptance is subject to Studio Kritique’s written confirmation.


14. International Shipping, Customs and Import Duties

14.1 International orders may be subject to customs duties, import taxes, GST/VAT, clearance fees, brokerage fees, storage fees, and other charges in the destination country.

14.2 These charges are not controlled by Studio Kritique and are the responsibility of the customer unless expressly stated otherwise in writing.

14.3 Studio Kritique is not responsible for customs delays, customs decisions, import restrictions, seizure, refusal, abandonment, additional charges, or destruction of shipments by customs or other authorities.

14.4 The customer is responsible for ensuring that the ordered product can be lawfully imported into the destination country.

14.5 If a shipment is returned to Studio Kritique due to non-payment of duties, incorrect address, customs refusal, customer refusal, failed delivery, or any customer-side issue, Studio Kritique may deduct shipping charges, return charges, customs charges, handling fees, and non-recoverable costs from any refund or credit, where applicable and permitted by law.


15. Final Fitting, Collection and Acceptance

15.1 The customer is expected to inspect the garment during the final fitting, at collection, or immediately upon delivery.

15.2 Once the customer approves the final garment, collects it, accepts delivery, or uses it, the garment will be considered accepted, except for hidden defects or rights that cannot be excluded under applicable law.

15.3 Any issue relating to damage, defect, incorrect item, or material deviation from the confirmed order must be reported in writing within 3 days of receipt or collection.

15.4 Studio Kritique will not be responsible for issues reported after the garment has been worn, washed, dry-cleaned, altered, damaged, stored improperly, or used for an event.


16. Care Instructions

16.1 The customer is responsible for following all care instructions provided with the garment or communicated by Studio Kritique.

16.2 Bespoke garments, delicate fabrics, embroidery, embellishments, handwork, trims, and structured pieces may require specialist care, dry cleaning, steam handling, careful storage, and limited exposure to heat, moisture, sunlight, perfume, cosmetics, or jewellery friction.

16.3 Studio Kritique is not responsible for damage caused by improper washing, dry cleaning, ironing, steaming, storage, use, handling, packing, travel, perfume, stains, body products, jewellery, or third-party service providers.


17. Website Content and Product Information

17.1 We make reasonable efforts to ensure that product descriptions, prices, images, timelines, and availability information on the Website are accurate.

17.2 However, errors may occur. We reserve the right to correct errors, update information, change prices, withdraw products, or cancel orders affected by incorrect information, subject to applicable law.

17.3 Website images are for visual reference. The final product may vary due to customisation, fabric availability, body measurements, handwork, lighting, styling, and screen settings.


18. Intellectual Property

18.1 All designs, sketches, patterns, images, photographs, videos, text, logos, graphics, embroidery concepts, garment concepts, website content, lookbooks, campaign materials, and other creative materials are the intellectual property of Studio Kritique or its licensors.

18.2 Customers may not copy, reproduce, distribute, modify, publish, commercially use, or create derivative works from Studio Kritique’s intellectual property without our prior written consent.

18.3 Any bespoke design, pattern, sketch, embroidery concept, or garment concept developed by Studio Kritique remains our intellectual property, even if it was developed for a customer order, unless expressly agreed otherwise in writing.


19. Photography, Reviews and Marketing

19.1 Studio Kritique may request permission to use customer photographs, fitting images, testimonials, reviews, or event images for marketing purposes.

19.2 We will not use identifiable customer images for marketing without customer consent.

19.3 Studio Kritique may use non-identifiable process images, close-up garment images, embroidery details, fabric details, studio images, or product images for portfolio, social media, quality, documentation, or marketing purposes, unless the customer has expressly requested confidentiality in writing and Studio Kritique has agreed.


20. Third-Party Services

20.1 The Website may use third-party tools or services, including payment gateways, shipping partners, analytics tools, communication tools, social media platforms, or embedded applications.

20.2 Studio Kritique is not responsible for third-party websites, platforms, technical failures, payment gateway issues, courier errors, or third-party policies, except where required by applicable law.


21. Limitation of Liability

21.1 To the maximum extent permitted by applicable law, Studio Kritique shall not be liable for indirect, incidental, special, consequential, emotional, reputational, event-related, opportunity-loss, business-loss, customs-related, courier-related, or punitive damages arising from or related to any order, product, delay, fitting, alteration, delivery, communication, or use of the Website.

21.2 Studio Kritique shall not be liable for losses arising from customer-provided incorrect information, incorrect measurements, missed fittings, delayed approvals, body changes, misuse of garments, improper care, third-party alterations, courier delays, customs delays, import restrictions, or circumstances beyond our reasonable control.

21.3 To the maximum extent permitted by applicable law, Studio Kritique’s total liability for any claim relating to a specific order shall not exceed the amount paid by the customer for that specific order.

21.4 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer rights under applicable consumer protection laws.


22. Force Majeure

22.1 Studio Kritique shall not be liable for delay or failure to perform any obligation due to circumstances beyond our reasonable control, including but not limited to natural disasters, floods, fire, strikes, transport disruption, courier failure, supplier delays, fabric shortages, artisan unavailability, illness, epidemic, pandemic, government restrictions, customs delays, power failure, technical failures, civil unrest, or other force majeure events.

22.2 If a force majeure event affects an order, Studio Kritique may offer a revised timeline, alternative material, rescheduling, credit, cancellation, or other reasonable solution depending on the circumstances and applicable law.


23. Grievance Redressal and Customer Support

23.1 For customer service, order support, complaints, returns, alterations, delivery issues, or other concerns, customers may contact us at:

23.3 We will endeavour to acknowledge receipt of consumer complaints within 72 hours and resolve them within one month from the date of receipt, in accordance with applicable Indian e-commerce consumer protection requirements.

23.4 Customers should include their name, order number, contact details, photographs where relevant, and a clear description of the issue when submitting a complaint.


24. Governing Law and Jurisdiction

24.1 These Terms shall be governed by and interpreted in accordance with the laws of India.

24.2 Subject to mandatory consumer protection rights and applicable law, the courts and competent forums in Bengaluru, Karnataka, India shall have jurisdiction over disputes arising from or relating to these Terms, the Website, our services, or any order placed with Studio Kritique.

24.3 Nothing in these Terms is intended to exclude consumer rights that cannot be excluded under applicable law.


25. Changes to These Terms

25.1 Studio Kritique may update or modify these Terms from time to time.

25.2 The updated version will be posted on the Website with a revised “Last updated” date.

25.3 Continued use of the Website, services, consultations, or ordering process after changes are posted constitutes acceptance of the updated Terms.
